Privacy & Personal Data Protection Policy

Kids Actually places great importance on protecting the personal data and respecting the privacy of our customers. This Privacy & Personal Data Protection Policy (the "Policy") governs the collection, use, and disclosure of Personal Data (as defined below) that we collect in connection with the goods and/or services we offer at Kids Actually. We aim to comply with the requirements of the Personal Data Protection Act  (“PDPA”) in respect of the collection, use and disclosure of your personal data. Please read the Kids Actually Privacy policy on how we manage your personal data.

1. General

1.1 This Policy statement outlines the obligations and policies of Kids Actually with regards to the Personal Data of individual customers. Kids Actually is committed to implementing, to the best of its ability, the principles and processes set out in this Policy across its operations.

1.2 The officers, management, and staff members of Kids Actually will make reasonable efforts to maintain the confidentiality and security of all Personal Data collected, stored, disclosed, or used on behalf of Kids Actually. Kids Actually will ensure that all collection, storage, disclosure, and usage of Personal Data is carried out appropriately and in compliance with the Act and this Policy.

1.3 For the purposes of this Policy, "Personal Data" refers to any data, whether true or not, that pertains to an individual customer and that can be used to identify that customer, either on its own or in conjunction with other data to which Kids Actually has or is likely to have access. This includes Personal Data that is currently in the possession of Kids Actually, as well as any that may be collected by Kids Actually in the future.

2. Access, correction, withdrawal of use of Personal Data

2.1 If you request access to and/or correction of Personal Data relating to you that is in the possession and control of Kids Actually, we will provide and/or correct that data in a reasonable time and manner in accordance with our standard procedures, as stated herein.

2.2 In accordance with the Act, Kids Actually has established a process for receiving and responding to any queries or complaints that may arise with respect to the application of this Act. To contact Kids Actually regarding any such queries or complaints, please send an email to our Data Protection Officer (the "DPO") at hello@kidsactuallysg.com.

2.3 If you do not wish for Kids Actually to use your Personal Data for any of the purposes listed in Clauses 3.2 to 3.4, or if you do not wish to receive promotional materials from Kids Actually, you may opt out by sending a clearly worded email to the DPO at the email address provided in Clause 2.2. Your request will be processed within a reasonable time.

3. Statement of Practices

3.1 Types of Personal Data Collected: Kids Actually collects various types of Personal Data from you, including your name, spouse's name, child's name, postal address, phone number (including mobile), e-mail address, bank account/credit card details, gender, Personal Data of your emergency contacts, IP addresses, and photographs and images, through our websites, smart phone applications, marketing events, and any forms used by Kids Actually from time to time. We also use cookies on our websites to track website visitorship and experience. Most web browsers are designed to accept cookies. If you do not wish to receive any cookies, you may set your browser to refuse them.

3.2 Purpose of Collection of Personal Data: Kids Actually collects Personal Data for various purposes, including processing your application and registration of your account with Kids Actually, providing our services to you, ascertaining if you are eligible for discounts, privileges or benefits, conducting market research and analysis, direct marketing through voice calls, text messages, email, direct mail, and facsimile messages, payment and/or credit control purposes, notifying you of any changes to our policies or services that may affect you, responding to queries and feedback, identification and club access, maintaining and updating your membership details, and informing you of new developments, services, and promotions of Kids Actually and other third parties that we are associated with.

3.3 Disclosure of Personal Data: In order to carry out the functions described above, Kids Actually may disclose your Personal Data internally. Additionally, Kids Actually may also disclose your Personal Data to the following third parties, namely: regulators and law enforcement officials, lawyers, auditors, third-party service providers and consultants, third-party investors, credit, debit and charge card companies, banks and other entities processing payment, and any agent or subcontractor acting on Kids Actually’s behalf for the provision of Kids Actually’s services.

3.4 Kids Actually may disclose your Personal Data to the above-mentioned parties in the occurrence of any of the following events: to the extent that Kids Actually is required to do so by law, in connection with any legal proceedings or prospective legal proceedings, to establish, exercise or defend Kids Actually's legal rights, to the purchaser (or prospective purchaser) of any company, business or asset which Kids Actually is (or is contemplating) selling, to any person and/or entity for the purpose of processing such information on Kids Actually’s behalf, to third parties who provide services to Kids Actually or on its behalf, to any third party that purchases Kids Actually or Kids Actually’s companies, business or any part of Kids Actually or Kids Actually’s business, for the purposes of disaster recovery, and any other purpose with your specific consent.

 

3.5 Optional Provision of Personal Data: In some instances, you may also be requested to provide certain Personal Data that may be used to further improve Kids Actually’s products and services and/or better tailor the type of information presented to you. In most cases, this type of data is optional, although where the requested service is a personalized service, or provision of a product or dependent on your providing all requested data, failure to provide the requested data may prevent Kids Actually from providing the service to you. This type of data includes, but is not limited to: your age, gender, profession, hobbies and leisure activities, other related products and services subscribed to, and family and household demographics.

 

3.6 Under certain circumstances, telephone calls made to Kids Actually are recorded for the purposes of quality control, appraisal, as well as staff management and development. In such an event, by agreeing to this Policy, you hereby give your clear and unambiguous consent for the collection, use and disclosure of such Personal Data in accordance with this Policy.

 

4. Accuracy of Verification of Personal Data

Kids Actually strives to maintain the accuracy and completeness of the Personal Data that we collect and use. To ensure the accuracy of your Personal Data, we may validate the information provided using generally accepted practices and guidelines. This may involve the use of check sum verification on numeric fields, such as account or credit card numbers. In some cases, we may be able to validate the data provided against pre-existing data held by Kids Actually. For certain types of Personal Data, such as Personal Identifiers or proof of address, we may require you to provide us with original documentation before we can use the information.

To assist us in maintaining the accuracy of your Personal Data, please inform us of any changes or updates to your information. If you wish to update any of your Personal Data, please send a clearly worded email to our Data Protection Officer (DPO) at the email address provided earlier in this policy. We will review your request and make the necessary updates in a timely manner, as required by applicable laws and regulations.

 

5. Protection of Security of Personal Data

5.1 Kids Actually is committed to protecting the privacy and security of your Personal Data. We employ commercially reasonable physical, managerial, and technical safeguards to ensure the integrity and security of your Personal Data. We will not knowingly allow access to this data to anyone outside Kids Actually, other than to you or as described in this Policy.

5.2 Despite our efforts to safeguard your Personal Data, please be aware that transmission of information over the internet is not completely secure and therefore, we cannot guarantee the absolute security of any information you transmit to Kids Actually. You transmit information to us at your own risk.

We take reasonable steps to protect your Personal Data against unauthorized access, alteration, disclosure, or destruction. These measures include but are not limited to: implementation of access controls, regular review of information collection, storage and processing practices, and maintenance of physical and electronic security measures. However, Kids Actually cannot ensure or warrant that your Personal Data may not be accessed, altered, collected, copied, destroyed, disposed of, disclosed or modified by breach of any of our physical, technical, or managerial safeguards.

 

6. Access and Correction of Personal Data

6.1 As per Clause 2.1 of this Policy, you have the right to:

a) check if Kids Actually holds any Personal Data related to you and, if so, obtain copies of such data; and

b) request Kids Actually to correct any inaccurate Personal Data related to you that is being used for its intended purpose.

6.2 Kids Actually reserves the right to charge a reasonable administrative fee to process your requests under Clause 6.1. We will notify you of the fee and only process your request upon payment of the fee.

 

6.3 To ensure the security of your Personal Data, Kids Actually may request proof of your identity before disclosing any information. You may be asked to provide your name, membership number, and NRIC or Passport or FIN number as proof of identity. You are responsible for maintaining the confidentiality of this information, as any request made using your membership details will be considered authorized by you. 

 

7. Storage and Retention of Personal Data

Kids Actually will only keep your Personal Data for as long as necessary to achieve the purposes for which it was collected, or as required by applicable law. Once the Personal Data is no longer necessary for these purposes, Kids Actually will take reasonable measures to securely destroy or permanently de-identify the Personal Data.

8. Contacting you

​

Kids Actually may contact you through the communication means you have provided, including your telephone number and e-mail address. By agreeing to this Policy through your sign-up forms, consent forms, or by any other means of indication, you consent to Kids Actually contacting you using all of the communication means you have provided, including e-mail, SMS, MMS, Whatsapp or any other Chat messages, for the purposes of providing you with information about Kids Actually's products and services.

If any of the communication means you have provided to Kids Actually is listed on the Do Not Call Registry (the "DNC"), Kids Actually will not contact you using that communication means unless you have given clear and unambiguous consent for Kids Actually to do so. If you no longer wish to receive such communications, you may opt-out at any time by contacting Kids Actually through the contact details provided in Section 2 of this Policy

 

9. Change and Updates to  Policy

Kids Actually reserves the right to modify any of the clauses contained in this Policy to comply with applicable laws and regulations or to meet its global policy requirements, as well as for any other purposes deemed reasonably necessary by Kids Actually. Any updates or amendments will be posted on our website and will become effective immediately upon posting. Your continued use of our services after any such updates or amendments constitutes your acceptance of the revised Policy.We encourage you to regularly review this Policy.

10. Governing Law and Jurisdiction 

​

This Policy shall be governed by and interpreted in accordance with the laws of Singapore. Any dispute arising out of or in connection with this Policy shall be subject to the non-exclusive jurisdiction of the courts of Singapore.

11. Miscellaneous

​

11.1 Scope of Policy

This Policy governs the collection and use of Personal Data by Kids Actually only. It does not cover any third-party sites to which we provide links, even if such sites are co-branded with our logo. Please note that Kids Actually does not share your Personal Data with third-party websites. We are not responsible for the privacy practices and conduct of these third-party websites. We recommend that you read their privacy policies before disclosing any Personal Data to these websites.

11.2 Third-Party Websites

Kids Actually will not sell your personal information to any third party without your permission. However, we cannot be held responsible or liable for the actions of third-party sites that you may have linked to or been directed to from Kids Actually’s website.

11.3 Children's Privacy

Our websites are not intended for and do not target children under the age of 18 years old. Kids Actually does not knowingly solicit personal information from children under the age of 18 years old or send them requests for personal data.
